⚠️ IMPORTANT: Please read these terms carefully before using our services. By accessing or using Openomi, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and Daemon Craft Inc. ("Company", "we", "our"), operating the Openomi platform.

By creating an account, accessing or using our services, you confirm that:

  • You have read and understood these Terms
  • You agree to be bound by these Terms
  • You are at least 18 years old and have the legal capacity to enter into contracts
  • If acting on behalf of an organization, you have authority to bind it

If you do not accept these Terms, you must not use our services.

2. Service Description

Openomi is a compliance audit platform for Canadian immigration that offers:

  • Automated analysis of immigration documents (bank statements, passports, LOAs, etc.)
  • Compliance verification with Immigration, Refugees and Citizenship Canada (IRCC) requirements
  • Anomaly detection and potential document fraud risk identification
  • Detailed audit report generation
  • AI assistant to answer questions about immigration procedures
  • Client file management (CRM)

📋 Important notice: Openomi is a decision-support tool. Our analyses and recommendations are based on Canadian immigration legislation, including the Immigration and Refugee Protection Act (IRPA), the Immigration and Refugee Protection Regulations (IRPR), and IRCC operational guidelines. However, they do not constitute legal advice and in no way guarantee the outcome of an application. Our audits and analyses do not replace advice from a Regulated Canadian Immigration Consultant (RCIC) or lawyer. Final decisions regarding immigration applications belong exclusively to IRCC.

3. User Account

3.1 Account Creation

To use Openomi, you must create an account by providing accurate and complete information. You agree to:

  • Provide truthful information during registration
  • Keep your information up to date
  • Protect the confidentiality of your login credentials
  • Not share your account with third parties
  • Notify us immediately of any unauthorized use

3.2 Account Responsibility

You are fully responsible for all activities conducted under your account, whether authorized or not. We are not responsible for losses resulting from unauthorized access to your account.

3.3 Professional Accounts

If you are a Regulated Canadian Immigration Consultant (RCIC) or immigration professional, you agree to comply with your profession's codes of ethics and applicable regulations.

4. Subscriptions and Payments

4.1 Plans and Pricing

Openomi offers different subscription plans and individual credit purchases. Current prices are displayed on our website and may be changed with 30 days' notice.

4.2 Billing

  • Subscriptions are billed in advance, monthly or annually
  • Payments are processed securely by Stripe
  • All prices are in Canadian dollars (CAD) and exclude applicable taxes
  • Purchased credits do not expire, unless otherwise stated

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each period, unless cancelled before the renewal date. You can cancel your subscription at any time from your account settings.

4.4 Refunds

Payments are generally non-refundable, except in the following cases:

  • Billing error on our part
  • Service unavailability for an extended period
  • Cancellation within 14 days of the first subscription (right of withdrawal)

5. Acceptable Use

5.1 Authorized Uses

You may use Openomi only to:

  • Verify compliance of legitimate immigration documents
  • Prepare and validate immigration files
  • Obtain information about Canadian immigration procedures
  • Manage your client files (for professionals)

5.2 Prohibited Uses

It is strictly prohibited to:

  • Upload fraudulent, falsified or stolen documents
  • Use the service to facilitate immigration fraud
  • Access the service through unauthorized automated means (scraping, bots)
  • Attempt to circumvent security measures
  • Resell or redistribute our services without authorization
  • Use the service for illegal purposes
  • Harass, threaten or harm other users
  • Upload malicious content (viruses, malware)
  • Impersonate another person or organization

🚫 Warning: Any violation of these rules may result in immediate suspension or termination of your account, without refund, and may be reported to the appropriate authorities.

6. User Content

6.1 Your Documents and Data

You retain all rights to the documents and data you upload to Openomi. By using our service, you grant us a limited license to:

  • Process and analyze your documents to provide our services
  • Store your documents securely
  • Generate reports based on your documents

6.2 Your Guarantees

By uploading content, you guarantee that:

  • You have the right to upload these documents
  • The documents are authentic and not falsified
  • You have obtained necessary consents if documents concern third parties
  • The content does not violate any law or third-party rights

7. Intellectual Property

7.1 Our Property

Openomi, including its design, features, source code, algorithms, documentation and content, is protected by copyright, trademarks and other intellectual property rights belonging to Daemon Craft Inc..

7.2 License to Use

We grant you a non-exclusive, non-transferable and revocable license to use Openomi in accordance with these Terms. This license does not give you any rights to our intellectual property beyond authorized use of the service.

7.3 Feedback

If you submit suggestions, ideas or feedback to us, you grant us the right to use them without restriction or compensation.

8. Privacy

The collection and processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. Privacy Policy.

We are committed to protecting your data in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws.

9. Limitation of Liability

9.1 Service "As Is"

Openomi is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted, secure or error-free.

9.2 Warranty Exclusions

To the fullest extent permitted by law, we exclude all warranties, express or implied, including:

  • Guarantee of audit results accuracy
  • Guarantee that the service will meet your specific needs
  • Guarantee that IRCC decisions will be favorable
  • Guarantee of detection of all fraud or anomalies

9.3 Limitation of Damages

In no event shall our total liability exceed the amount you have paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or immigration opportunities.

Note: Some jurisdictions do not allow exclusion of certain warranties or limitations of liability. In such cases, these exclusions will apply to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend and hold harmless Daemon Craft Inc., its officers, directors, employees and agents against any claims, liabilities, damages, losses or expenses (including attorney fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of third-party rights
  • Content you upload
  • Any fraudulent activity on your part

11. Termination

11.1 Termination by You

You may terminate your account at any time from your account settings or by contacting us. Termination takes effect at the end of the current billing period.

11.2 Termination by Us

We may suspend or terminate your access immediately, without notice, if:

  • You violate these Terms
  • You use the service for fraudulent purposes
  • You do not pay fees due
  • The law requires it

11.3 Effects of Termination

After termination, you lose access to your account and data. We will retain certain data in accordance with our retention policy and legal requirements.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. In case of significant changes, we will notify you by:

  • Email to the address associated with your account
  • Notification on the platform
  • Publication on our website with the update date

Your continued use of the service after notification constitutes your acceptance of the modified terms. If you do not accept the new terms, you must stop using the service.

13. Applicable Law

13.1 Applicable Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

13.2 Jurisdiction

Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of the Province of Alberta, Canada. You waive any objection based on forum non conveniens.

13.3 Dispute Resolution

Before initiating any legal proceedings, you agree to attempt to resolve any dispute in good faith by contacting us at legal@openomi.io. We commit to responding within 30 days.

14. Miscellaneous

14.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the service.

14.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, the other provisions will remain in full force and effect.

14.3 Waiver

Failure to exercise a right under these Terms does not constitute a waiver of that right.

14.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition or sale of assets.

14.5 Force Majeure

We are not responsible for delays or failures resulting from circumstances beyond our control (natural disasters, outages, government acts, etc.).

16. IRPR s. 91 — Immigration Representation Disclaimer

Openomi is a SaaS technology platform. We do NOT provide immigration advice and we do NOT represent any person before Immigration, Refugees and Citizenship Canada (IRCC) or any tribunal.

  • Under section 91 of the Immigration and Refugee Protection Act (IRPA), only members in good standing of the College of Immigration and Citizenship Consultants (CICC), of a Canadian provincial bar, or of the Chambre des notaires du Québec, are authorised to provide immigration advice or representation for compensation.
  • The audits, analyses, evaluations and outputs generated by our AI tools are decision-support aids, NOT a substitute for the professional judgement of an authorised representative.
  • For RCIC, lawyer or notary professional users : you remain solely responsible for files submitted to IRCC under your name and licence number, including the validation of any AI output before its use.
  • For end-user clients (applicants) : we strongly recommend that you retain an authorised representative (CICC, bar, Chambre des notaires) for the official preparation of your application. You may verify the status of a representative at college-ic.ca or your provincial bar.

Daemon Craft Inc. accepts no liability for an unfavourable IRCC or court decision based, in whole or in part, on the use of our outputs without independent professional review.

By using Openomi, you confirm that you have read, understood and accepted these Terms of Use and our Privacy Policy.
